Welcome to Friends’ Game, a mobile game application (“App”) developed and operated by Grappetite LLC (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the App and any related services. By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent that you meet these requirements.
Accessibility: We strive to make the App inclusive, but some features, such as drawing or selfie-based challenges, may not be fully accessible to all users due to physical or technical limitations. 2. Game Overview
The App allows users to:
Join multiplayer games via Game ID (a unique access code).
Participate in mini-games, including drawing competitions, selfie challenges, and other creative or competitive tasks.
Vote or rate the performance of other players. While typically played in person, users can join remotely by entering a Game ID.
Game ID Security: You are responsible for securely sharing Game IDs only with intended participants. Sharing Game IDs publicly or failing to secure them may allow random or unauthorized individuals to join your game session by guessing or obtaining the Game ID. We are not responsible for any issues, including inappropriate behavior or content, resulting from unauthorized or random participants joining your game.
3. User Content and Conduct
You may submit, upload, or create content such as photos, selfies, and drawings (“User Content”). By submitting User Content, you agree to the following:
3.1 Acceptable Use
You must not upload, create, or share content that:
Is sexually explicit, violent, threatening, harassing, or otherwise inappropriate.
Contains nudity or sexually suggestive imagery.
Is hateful, discriminatory, or promotes harm.
Violates any applicable law or regulation. We reserve the right to remove, block, or report inappropriate content and to restrict users who violate these rules without notice, to the extent possible within the App’s functionality.
3.2 Content Moderation
As the App does not require user sign-up, the game owner (the user who creates the game) is primarily responsible for ensuring that only trusted individuals are invited to join their game session via the Game ID. Game owners should monitor participant behavior and content to maintain a safe and respectful environment. We may use automated tools or community reporting to assist in reviewing content, but we cannot guarantee all offensive material will be caught. Please use the in-app reporting tools to flag inappropriate content or behavior promptly, and we will take reasonable steps to address violations within the limitations of the App’s design.
3.3 Community Guidelines
To maintain a safe, respectful, and fun environment for all players, users agree to follow these Community Guidelines:
Respect others: Do not insult, mock, harass, or shame other players for their photos, drawings, or gameplay performance.
Keep it appropriate: All content, including usernames, drawings, and photos, must be suitable for users aged 13 and up.
No bullying or hate speech: We have a zero-tolerance policy for content that is abusive, discriminatory, or targets others based on race, gender, sexuality, religion, or other protected traits.
Be a good sport: Friendly competition is encouraged, but toxic behavior, taunting, or excessive criticism is not.
Play fair: Do not cheat, exploit bugs, or misuse game features to gain an unfair advantage. Violations of these guidelines may result in warnings, content removal, or restrictions on participation, at our sole discretion, within the technical capabilities of the App.
4. Intellectual Property
4.1 Your Content
You retain full ownership of all content you submit. We do not use, reproduce, share, or distribute any user-submitted content outside of the App experience. User content is only visible to participants within the relevant game session. We do not claim any rights to your photos, selfies, or drawings and we do not use them for marketing, analytics, or promotional purposes. Content Storage and Deletion: User Content is stored temporarily for gameplay purposes and deleted after 30 days or upon game session completion, whichever is sooner. You may request deletion of your content by contacting us at support@grappetite.com, subject to applicable laws.
4.2 Our Content
All intellectual property in the App (graphics, UI, code, branding, etc.) is owned by us or our licensors. You may not copy, distribute, or modify any part of the App without written permission.
5. Advertisements
The App may display advertisements. We are not responsible for the content, accuracy, or privacy practices of third-party advertisements. Your interactions with ads are subject to the terms and policies of the respective advertisers.
6. Data Collection and Privacy
We may collect data including:
Username or nickname
Game participation history
Submitted drawings/photos (stored locally or temporarily for gameplay)
Device identifiers and analytics
We use this data to operate and improve the App. By using the App, you consent to our data practices as outlined in our Privacy Policy, available at www.grappetite.com/privacy.We do not sell, reuse, or publish your user-generated content or personal information. 7. Termination
We may suspend or terminate your access to the App for violations of these Terms or for any reason without notice. Upon termination, your right to use the App ends immediately.
8. Disclaimers
The App is provided “as is” and we make no warranties regarding availability, performance, or accuracy.
We are not responsible for content posted by users or for actions taken during gameplay.
Use the App at your own risk. Connectivity and Performance Disclaimer:
The quality of your gameplay experience may depend on your internet connection, device performance, and network stability.
We are not responsible for any gameplay disruptions, delays, or losses resulting from slow internet, disconnections, device lag, or other technical issues outside of our control.
Users are solely responsible for maintaining a stable internet connection while using the App, especially during live or competitive game sessions.
Force Majeure: We are not liable for any failure to perform our obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, cyberattacks, or government regulations.
9. Limitation of Liability
To the maximum extent permitted by law:
We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, emotional distress, or reputational harm.
We are not responsible for any harm, embarrassment, offense, or emotional impact caused by content uploaded by you or other users, including content that may be visible, rated, judged, or commented on by other participants.
You acknowledge that by participating in interactive games involving selfies, drawings, or other user-generated content, you do so at your own discretion and risk, and you are solely responsible for what you choose to share.
We make reasonable efforts to moderate inappropriate content, but we cannot guarantee all offensive or harmful material will be identified or removed immediately.
10. Additional Legal Terms
10.1 User Responsibility
You are solely responsible for the content you upload, submit, or share while using the App. We do not pre-screen content and cannot guarantee that others will not misuse or misinterpret what you submit. Please avoid sharing personal, sensitive, or potentially embarrassing content.
10.2 No Expectation of Privacy Between Players
Content submitted in a game may be visible to all participants in that game. By joining a game session, you acknowledge and agree that your submitted content will be seen, judged, or rated by other users in that game and that we are not responsible for their responses or actions.
10.3 Service Modifications
We may modify, suspend, or discontinue parts of the App or certain game features at any time, with or without notice. We are not liable to you or any third party for any such changes, including loss of functionality or data. Beta Features: From time to time, we may offer beta or experimental features. These features are provided “as is” with no warranties and may be discontinued or modified at any time without notice.
10.4 Parental Responsibility
If you permit a child under 18 to use the App, you are responsible for monitoring their activity and ensuring they comply with these Terms. We are not responsible for content accessed or shared by minors. We may use reasonable measures to verify user age. Parents or guardians are encouraged to use device-level parental controls to manage content sharing or access to game features by minors.
10.5 Reporting Abuse
If you encounter content or behavior that violates these Terms or makes you feel unsafe, please report it immediately through the in-app reporting tools or by contacting us at support@grappetite.com.
10.6 Indemnification
You agree to defend, indemnify, and hold harmless Grappetite LLC, its affiliates, employees, and partners from any claims, losses, liabilities, damages, or expenses (including reasonable legal fees) arising out of your use of the App, your content, or your violation of these Terms.
10.7 Governing Law and Dispute Resolution
These Terms are governed by the laws of California, USA, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association. You waive the right to participate in class action lawsuits.
10.8 User Feedback
Any feedback, suggestions, or ideas you provide about the App may be used by us without any obligation to compensate you or maintain confidentiality. By submitting feedback, you grant us a perpetual, royalty-free license to use it.
10.9 Third-Party Services
The App may integrate with third-party platforms (e.g., ad networks). Your use of these services is subject to their respective terms and policies. We are not responsible for the availability, security, or practices of third-party services.
11. Changes to These Terms
We may update these Terms at any time. Continued use of the App after changes means you accept the new Terms. We recommend checking this page regularly. We may notify you of significant changes via in-app messages or email.
